These General Terms and Conditions of Sale exclusively govern the sale of products offered on the Agafay Books website. They are made available to the buyer at the time of order placement. By placing an order on the Agafay Books website, the buyer expressly acknowledges having read and accepted, without reservation, the present General Terms and Conditions of Sale, to the exclusion of any other terms or conditions appearing in brochures, catalogs, or any other documents issued by the seller, which are provided for information purposes only.
The sale of products offered on the Agafay Books website is strictly reserved for the final consumer, defined as any natural person acting for personal use, not acting in a professional or commercial capacity, and having the legal capacity to enter into a contract.
Notwithstanding the foregoing, Agafay Books may, on an exceptional basis, accept orders from bookstores, resellers, schools, companies, or associations, provided that such orders are placed using a specific promotional or partner code previously communicated by Agafay Books.
Outside of this specific framework, orders placed by professionals shall not be accepted. In this respect, Agafay Books reserves the right to cancel any order deemed to be abnormal, including, but not limited to, orders involving quantities exceeding the normal needs of a consumer or orders resulting from unusual purchasing patterns associated with the same billing and/or delivery address.
The validation of an order on the Agafay Books website, by clicking the confirmation button after reviewing the shopping cart, constitutes the buyer’s full and unconditional acceptance of the present General Terms and Conditions of Sale. Such validation constitutes a firm and irrevocable contractual commitment on the part of the buyer.
Accordingly, no order may be placed on the Agafay Books website unless the buyer has first accepted, without reservation, all of the conditions set forth herein.

Promotional offers proposed by Agafay Books are valid only for the period indicated for each offer and subject to product availability.

Prices displayed on the Agafay Books website are indicated in Moroccan dirhams (MAD), all taxes included (VAT included), excluding delivery or handling fees (see the “Delivery” section). Order Placement Procedure
The steps required to place an order on the Agafay Books website are as follows:
You select the book(s) and/or product(s) of your choice and add them to your shopping cart. At any time prior to order validation, you may review the contents of your cart, check the corresponding prices and make any necessary modifications.
You then log in using your email address and password. If you are a new customer, you may create an account by providing a valid email address and choosing a personal and confidential password, which will allow you to identify yourself during future visits to the website.
If you do not wish to create an account or log in, you may place an order as a guest by directly providing the information required for delivery (last name, first name, telephone number and full delivery address).
You then select your preferred delivery method, validate it, and choose one of the payment methods offered on the website, which you also validate.

Order Confirmation and Processing
Once validated, the order is processed by the Agafay Books customer service department. Upon registration of the order, a confirmation email is sent to the customer. This confirmation summarizes all the essential elements of the order, including the products ordered, the total amount charged and the delivery terms.
The customer agrees that Agafay Books’ order recording systems constitute proof of the contractual relationship, its content and its date. Agafay Books reserves the right to cancel any order for a legitimate reason, in particular in the event of an abnormal order. In such a case, the customer will be informed of the cancellation as soon as possible.
Finally, customers are informed that the same reference of a book and/or product may not be ordered in a quantity exceeding nine (9) units per order, unless prior express agreement is granted by Agafay Books.
Delivery
Agafay Books undertakes to ensure the prompt and secure delivery of customer orders.
Delivery Methods:
Orders are delivered through courier and logistics service providers selected for their reliability. The most appropriate delivery method is chosen based on the destination of the order.
Delivery Fees:
Delivery fees vary according to the city of destination and the volume of the order. The total amount of shipping costs is clearly indicated to the customer at the time of order validation, prior to payment.
Order Modifications
Any order validated by the customer is deemed final and binding and may not be modified. The customer must wait until receipt of the order to submit, where applicable, a request for return, exchange or refund, in accordance with the applicable return and refund policy.
Cancellations
Agafay Books acknowledges that certain circumstances may require the cancellation of an order.
Cancellation Before Shipment:
The customer may cancel the order free of charge as long as it has not yet been shipped. To do so, the customer must contact customer service as soon as possible. If the order has not yet been prepared for shipment, it will be canceled and fully refunded using the original payment method.
Cancellation After Shipment:
Once the order has been shipped, it can no longer be canceled. However, the customer retains the right to return the products in accordance with the return and refund policy after receipt of the order.
Failed Delivery:
In the event that delivery cannot be completed due to incorrect or incomplete delivery information, or due to the customer’s absence at the time of delivery, the order may be canceled and returned to Agafay Books. In such cases, delivery or reshipment costs may be deducted, and only the value of the products may be refunded.
Accuracy of Delivery Address
The customer is required to provide an accurate, complete, and valid delivery address when placing an order. Any error or omission may result in delivery delays or failure, without Agafay Books being held liable.
Delivery Delays

International Orders
Eligibility for International Orders
Agafay Books primarily operates and delivers its products within Morocco. However, given the international nature of e-commerce, Agafay Books also accepts orders from customers located outside Morocco.
By placing an order from abroad, the customer acknowledges and agrees to all specific conditions applicable to international orders.
International Shipping
International orders may be subject to additional shipping fees and specific delivery timeframes, which will be communicated to the customer after order validation.
Shipping costs and delivery times vary depending on the weight, dimensions of the order, and the destination country.
Delivery Timeframes
Delivery times for international orders may vary significantly depending on the destination. While Agafay Books strives to provide accurate delivery estimates, it cannot be held responsible for delays caused by customs procedures, carriers, or any other event beyond its control.
Customs Duties, Taxes, and Import Fees
International orders may be subject to customs duties, local taxes, and import fees imposed by the destination country.
Such charges are not included in the product prices or shipping fees charged at checkout and are entirely borne by the customer.
The customer is solely responsible for paying all customs clearance fees in their country.

Currency and Payment
Prices displayed on the Agafay Books website are indicated in Moroccan Dirhams (MAD). For international orders, the charged amount may be converted into the customer’s local currency according to the exchange rate applied by the payment service provider at the time of the transaction.
The customer agrees to bear any currency conversion fees or international banking charges associated with the payment.

Payment Terms
Payments for purchases made on the Agafay Books website are made exclusively in Moroccan Dirhams (MAD).
Agafay Books offers the following payment method: payment by bank card at the time of order placement.
The Interbank Electronic Banking Center (CMI) has implemented security measures aimed at strengthening the protection of electronic payments, particularly those conducted over the Internet, in order to ensure safer access to online payment services. For further information, customers are invited to contact their bank or usual payment service provider.
In the case of payment by bank card, the amount is debited at the time the order is validated.
All online payment transactions carried out on the Agafay Books website are fully secure.
When the customer chooses to pay online, the bank card information is transmitted in encrypted form (SSL protocol) to a secure payment service provider. This provider communicates with the relevant banking servers to prevent fraud and abuse and then issues a payment authorization to Agafay Books.
At no time does Agafay Books have access to the full bank card details entered by the customer.
Returns and Right of Withdrawal – “Satisfaction Guaranteed or Your Money Back”
If a book or product ordered on the Agafay Books website does not meet your expectations, you benefit from a right of withdrawal in accordance with the provisions of Law No. 31-08 on consumer protection (Article 36).
The customer has a period of seven (7) days from the date of receipt of the entire order to exercise the right of withdrawal, without having to provide any justification.
To exercise this right, the customer must inform Agafay Books of their decision to withdraw within the applicable period, either by email or via the “Contact” section of the Agafay Books website. An acknowledgment of receipt will be sent by email.
The customer must then return the concerned product(s) as soon as possible and no later than seven (7) days following notification of the withdrawal decision, in their original packaging, in perfect condition, unused and undamaged, to the address communicated by Agafay Books.
Refund Terms
Agafay Books undertakes to issue a refund as soon as possible and no later than fifteen (15) business days from notification of the withdrawal decision. However, the refund may be postponed until the products have been effectively received or until proof of shipment is provided by the customer.

Legal Warranties
In accordance with the provisions of Law No. 31-08 relating to consumer protection, the customer has the opportunity, prior to final validation of the order on the Agafay Books website, to review the details of the order and correct any potential errors.
Pursuant to Law No. 53-05 relating to the electronic exchange of legal data, the order placed on the Agafay Books website may be retained by both Agafay Books and the customer as proof of the contractual obligations binding the two parties.
In accordance with Law No. 31-08, following validation of payment, a detailed order summary is sent to the customer at the email address provided at the time of placing the order.
Agafay Books guarantees the confidentiality of the personal data transmitted by the customer after identification, in accordance with the provisions of Law No. 09-08 relating to the protection of individuals with regard to the processing of personal data.
In accordance with Article 39 of Law No. 31-08, the delivery period for ordered products shall not exceed thirty (30) days, unless otherwise agreed by the parties.
Finally, in accordance with Article 36 of Law No. 31-08, the customer benefits from a right of withdrawal allowing termination of the contract within seven (7) days from receipt of the order, without having to provide any justification, under the conditions provided for by the applicable regulations.
Liability
The books and products offered for sale on the Agafay Books website comply with the Moroccan legislation in force.
Agafay Books shall not be held liable for non-performance or improper performance of the contract in the event of force majeure, disruptions, total or partial strikes—particularly affecting postal services, carriers, or means of communication—or any other event beyond its control.
The Agafay Books website may contain hypertext links redirecting to third-party websites. Agafay Books disclaims all liability for the content of such websites, particularly where such content violates applicable legal or regulatory provisions.
Furthermore, Agafay Books specifies that any creation of a hypertext link to the homepage of the Agafay Books website or to any of its pages is subject to the prior written authorization of Agafay Books.
Intellectual Property

The delivery conditions offered apply only within Morocco. Accordingly, these conditions apply to sales concluded and performed in Morocco.
The language of this contract is English. In the event of a dispute, the Moroccan courts shall have exclusive jurisdiction.
